By accessing and using EchoGift's services ("we," "us," or "our"), you ("customer," "you," or "your") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Service Description

EchoGift provides custom AI-generated song creation services, including:

• Personalized songs based on customer-provided stories and preferences
• Custom song albums (5 songs)
• Custom artwork accompanying songs/albums
• Digital delivery in WAV and MP3 formats

3. Pricing and Payment

Pricing:

• Single Personalized Song: $49.99 (includes custom artwork)
• Custom Song Album (5 songs): $199.99 (includes custom artwork)

Payment Terms:

• Payment is required in full before work begins
• All payments are processed securely through Stripe
• Prices are subject to change without notice for future orders

4. No Refund Policy

IMPORTANT: All sales are final. We do not offer refunds for any reason.

By placing an order, you acknowledge that:

• You understand our no-refund policy
• You have carefully reviewed your order details before payment
• You accept the custom nature of our digital products
• Once work has begun, no refunds will be issued under any circumstances

5. Revision Policy

One (1) Revision Maximum:

• If you are not satisfied with your completed song, we will provide ONE (1) edited version at no additional charge
• Revision requests must be submitted within 7 days of delivery
• Revisions are limited to adjustments to existing content, not complete rewrites
• After the one revision is delivered, no further changes will be made
• Revisions do not extend delivery timelines for future orders

6. Customer Information Responsibility

Your Information is Our Only Source:

• We create songs based solely on the information you provide in your order form
• You are responsible for the accuracy and completeness of all information submitted
• If you input incorrect names, dates, stories, or details, it is your responsibility
• We cannot recreate songs due to customer input errors
• Double-check all information before submitting your order
• We are not liable for songs created with incorrect customer-provided information

7. Intellectual Property and Usage Rights

Your Rights to the Song:

• Upon full payment, you own the rights to your custom song
• You may use the song for personal, commercial, or any other purpose
• You may sell, license, or distribute the song as you see fit
• No attribution to EchoGift is required for usage

Our Rights:

• We retain the right to use songs as samples for marketing purposes (with customer permission)
• We retain ownership of our proprietary AI technology and processes
• We may feature customer testimonials and feedback

8. Delivery and Timeline

Delivery Terms:

• Songs are delivered digitally via email within 2 business days
• Delivery includes both WAV and MP3 formats
• Custom artwork is included as a PNG file
• You are responsible for downloading and saving your files
• We are not responsible for email delivery issues on your end

9. Content Guidelines and Restrictions

Prohibited Content:

We reserve the right to refuse service for songs containing:

• Hate speech, discrimination, or offensive content
• Explicit sexual content or inappropriate material
• Copyrighted material that you do not own
• Illegal activities or content
• Content that could harm EchoGift's reputation

If your order is refused due to inappropriate content, you will receive a full refund.

10. Limitation of Liability

IMPORTANT LEGAL PROTECTIONS:

• EchoGift's liability is limited to the amount paid for services
• We are not liable for any indirect, consequential, or punitive damages
• We are not responsible for how you use the completed song
• We are not liable for technical issues with file playback on your devices
• We are not responsible for any emotional distress or disappointment
• Our services are provided "as is" without warranties of any kind

11. Dispute Resolution

Dispute Process:

• All disputes must be communicated via email to: hello@echogifts.shop
• We will attempt to resolve disputes within 14 business days
• If resolution cannot be reached, disputes will be handled through binding arbitration
• Customer agrees to resolve disputes individually, not as part of a class action
• Any legal proceedings must be conducted in the jurisdiction where EchoGift operates

12. Force Majeure

EchoGift is not liable for delays or failures in performance due to circumstances beyond our control, including but not limited to natural disasters, technical failures, or other unforeseeable events.

13. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated date. Continued use of our services after changes constitutes acceptance of new terms.
